Navigating the NAR Class Action Settlement’s Impact on Buyers and Sellers

The National Association of Realtors (NAR) class action lawsuit settlement is causing quite a stir in the media, and we have been engaging clients in discussions about how it will impact the market here in San Francisco. So, what is changing? At the core, not a whole lot, to be frank. Brokerage commissions are, and always have been, negotiable and the subject of meaningful conversations with our clients on how agents get paid, as well as the impact of shifting some of the commission burden from sellers (the traditional model) to buyers. The NAR settlement IS changing how the commissions (soon to be referred to as “concessions”) are advertised as sellers’ offers to pay buyers’ brokers will no longer be published on the MLS. Instead, sellers can advertise the “concessions” offered to buyers’ agents just about anywhere else, including brokerage websites, paid digital and print advertisements as well as property marketing materials that are published anywhere except the MLS. When it comes down to it, working with a full-service, experienced agent makes a difference in a successful home purchase or sale. Hottest Market Since the Peak of the Pandemic Boom
Ever since the beginning of the year, and now moving into the spring selling season, striking shifts in supply and demand have occurred and continued to accelerate, resulting in a dramatic leap in the heat and competitiveness of market conditions. Based on current indicators and, more importantly, what is being experienced on the ground as new listings arrive on the market, deals are negotiated, and homes go into contract, it appears likely that significant home price increases will begin to show up in Q2 2024.
